Welcome to BATS CLOUDS. By accessing or provisioning infrastructure on our platform, you explicitly agree to be legally bound by these Terms of Service. Please read them carefully.
1. Services Offered
BATS CLOUDS provides VPS (Virtual Private Server) and Cloud Hosting services. We offer various hosting plans including shared hosting, VPS hosting, dedicated servers, cloud hosting, and related services.
2. Account Registration & Security
Clients are solely responsible for keeping their cloud credentials, SSH keys, and passwords secure. You must be at least 18 years old or legally recognized as an adult in your jurisdiction to provision our Cloud/VPS instances. BATS CLOUDS is not liable for data loss arising from compromised user credentials.
3. Payment Terms
- All prices displayed are in Indian Rupees (INR), inclusive of local taxes where explicitly stated.
- We mandate upfront payments via Cashfree or UPI before server instantiation.
- All payments are final as per our Refund Policy.
- Users must not use our services for any illegal activities.
4. Acceptable Use Policy (AUP)
Users must not use services for illegal activities such as hacking, spamming, or fraud. BATS CLOUDS network cannot be used for any illegal operations. You agree NOT to use your VPS for:
- Hosting Botnets, executing DDoS attacks, or outbound IP spoofing.
- Cryptocurrency mining on shared CPU threads.
- Distributing unlicensed copyrighted material or Phishing scripts.
- Sending unauthenticated bulk SPAM emails.
5. Account Suspension & Termination
Zero Tolerance: Accounts may be suspended without notice if misuse is detected. BATS CLOUDS reserves the irrevocable right to instantly suspend or permanently terminate any server, delete associated data, and ban user IPs without prior warning if a severe violation of the Acceptable Use Policy (AUP) is detected. No refunds will be provided for accounts terminated due to AUP violations.
6. User Responsibilities
- Users are responsible for maintaining the security of their servers.
- Users must ensure their use of services complies with all applicable laws.
- Users are responsible for backing up their own data.
- Users must not engage in any activities that could harm the network or other users.
7. Service Level Agreement (SLA)
We commit to an industry-standard 99.9% network uptime SLA. In case of unexpected hardware failure causing downtime exceeding 6 hours, we will credit your account proportionally upon technical review.
8. Limitation of Liability
BATS CLOUDS furnishes "Unmanaged" servers by default unless a Managed Plan is purchased. We are not liable for operating system corruptions, third-party software incompatibilities, or lost business revenue resulting from server unavailability. Our maximum liability shall strictly not exceed the monthly recurring cost of your active plan.
